Agreement

These terms are a contract between you and Innerealm, the operator of innerealm.com. A separate legal-entity name has not yet been published here. Until it is, “Innerealm”, “we”, and “us” mean that operator. By creating an account, starting a practice, or paying for a plan, you agree to these terms and to the Privacy notice. If you do not agree, do not use the service.

The service is the website at innerealm.com, the practice at /app on that website, and the same practice on app.innerealm.com when that host is offered. These terms cover both.

The service

Innerealm is a guided contemplative practice: pictures, music, gentle sound, and a calm voice. You may sit with an intention. The service does not promise that a thought, a sitting, or a subscription will produce any result in your life.

The service is not medical care, psychotherapy, psychiatry, or a diagnosis. It is not a substitute for professional care. Nothing on the site is medical advice. If you may be in danger, or you need urgent help, contact local emergency services. Do not use the sitting as treatment.

Eligibility

You must be at least 18 years old, and able to form a contract, to use the service. By creating an account you confirm that you are. We may close an account that we learn belongs to someone younger.

Accounts

You may create an account with Google, or with a sign-in link sent to your email from hello@innerealm.com. You are responsible for the email account and the Google account you use, and for what happens under your sign-in. Tell us at hello@innerealm.com if you believe the account is being used without your permission.

Account shows the email on the sign-in, the plan, the status, the billing interval, the period end, and whether the one-time trial is ready or used. We keep an entitlement record for that purpose, as described in the Privacy notice. Words you type during a sitting stay in your browser. They are not uploaded to an Innerealm database in this version of the service.

Subscriptions

Paid plans are billed by Stripe in United States dollars. Essential is $9.99 a month, or $79 a year, and opens a practice of up to 15 minutes a day. Deep is $24.99 a month, or $199 a year, and opens a practice of up to 45 minutes a day, in one sitting or split into as many as three. Essential and Deep are the same guided practice at different lengths. Prices may be changed for later periods. The price shown at Checkout is the price for the period you are buying.

A subscription renews automatically at the end of each billing period, at the then-current price for that plan and interval, until you cancel. Checkout requires a signed-in account. Manage billing opens the Stripe Customer Portal. Cancel there. Cancellation stops the next renewal. It does not cut short the period you have already paid for, unless the law requires otherwise. We do not operate a separate card form. Card changes, invoices, and cancellation happen in the Portal.

If a payment fails, access may pause until Stripe reports the subscription as active again. We may refuse a new Checkout where an active plan is already on the account.

Trial

A new account may include one practice of 15 minutes, once. It is not a second plan, it does not renew, and it does not open the Deep length. Starting that practice marks it used. A paid plan does not spend the trial, and using the trial does not by itself start a paid plan. When the trial has been used, a further practice requires an active Essential or Deep plan.

Promotions

Checkout may accept a promotion code. INNEREALM1, when it is valid, takes one United States dollar (USD 1) off one invoice. A code is good only on the terms stated at Checkout, only while we offer it, and only once where the code says so. Codes have no cash value, may not be copied or resold, and may be withdrawn or refused if misused. A code does not change the length of Essential or Deep.

Refunds

Fees are non-refundable, except where the law requires a refund. A cancellation stops future renewal. It is not a refund of the current period. If a mandatory consumer right in your place of residence requires a refund or a cooling-off period that we cannot exclude, that right applies to the extent of the law and these terms do not take it away.

Acceptable use

You agree that you will not:

• use the service if you are under 18;
• present Innerealm as medical care, or make a cure claim for it;
• interfere with the service, probe it, or attempt to break access controls;
• share a sign-in in order to avoid a subscription, or resell access;
• copy the practice, the voice, or the pages except as these terms allow;
• use the service in a way that is unlawful, or that harms another person.

We may suspend or close access if you break these terms. We will tell you at the email on the account when it is reasonable to do so.

Intellectual property

The website, the practice, the text, the sound, the visuals, and the marks are owned by the operator or by its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the service for your own sitting, for as long as your trial or your paid plan allows. That licence ends when your access ends. You receive no ownership of the service. You keep whatever right you already have in words you type. Those words, in this version, stay on your device.

Disclaimer

The service is provided as is and as available. To the fullest extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose, quiet enjoyment, and non-infringement, and any warranty that the service will be uninterrupted, error-free, or fit to treat a condition. A sitting can stir feeling. You are responsible for deciding whether to continue. Nothing in these terms excludes a right, warranty, or liability that the law of Hong Kong, or another law that applies to you and cannot be excluded, does not allow us to exclude.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profit, data, or goodwill, arising out of the service or these terms.

Our total liability arising out of the service or these terms will not exceed the greater of (a) the fees you paid to Innerealm for the service in the twelve months before the event giving rise to the claim and (b) fifty United States dollars (USD 50).

These limits do not apply to liability that cannot legally be limited, including liability for death or personal injury caused by negligence where the law forbids that limit, or for fraud.

Indemnity

You will indemnify the operator against claims, losses, and reasonable expenses arising out of your misuse of the service, your breach of these terms, or your presenting the service as medical treatment. We will give you notice of a claim that is ours to hand to you, where the law and the circumstances allow. This indemnity does not apply to the extent the claim is caused by our own breach or negligence.

Termination

You may stop using the service at any time. Cancel a paid plan in the Customer Portal, and write to hello@innerealm.com if you want the account record deleted. We may suspend or end access if you break these terms, if we stop offering the service, or if we are required to. Sections that by their nature should continue, including intellectual property, disclaimers, liability, indemnity, and governing law, continue after access ends.

Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of the Hong Kong Special Administrative Region have exclusive jurisdiction over disputes arising out of these terms or the service, without prejudice to any mandatory right you have to bring a claim in a court that the law does not allow us to exclude. A failure to enforce a term is not a waiver. If one term is unenforceable, the rest remains in force.
